Upcoming Court Dates

Sentence Reduction/Day Parole Motion Hearing:

When: October 29 at 1:30 p.m. (Please check the night before to make sure this date has not changed.)
Where: Livingston County Judicial Center
What: Because Josh is unable to engage in reunification therapy while incarcerated, the Michigan Innocence Clinic will argue for a reduction in Josh’s sentence and/or grant day parole for the purpose of participating in family therapy.
How you can help: Your attendance at court is a great encouragement to the Burns family. It lets the court and community know that we continue to stand with the Burns family in their fight for justice.

 

Preliminary Evidentiary Scheduling Hearing:

When: November 5 at 1:30 p.m.
Where: Livingston County Judicial Center
What: This hearing will be held to determine if and when an evidentiary hearing will be heard on Josh’s motion for a new trial.
How you can help: Again, your attendance would be greatly appreciated in showing your support to the Burns family.
Appeals Process: Some have asked us how the appeals process works. The first step is to file a motion for a retrial. If granted, a retrial would take place in the original court with the same judge. If a retrial is denied, the appeals process moves up to the Michigan Court of Appeals.
